The Nederlander Organization Accessible Seating

The Nederlander Organization recognizes the needs of persons with disabilities, as defined by the Americans with Disabilities Act (ADA) of 1990 and continues to make every effort to comply with both ADA and state accessibility mandates. In addition, we strive to accommodate the individual needs of guests with disabilities.

The Nederlander Organization has undertaken extensive renovation of seating areas at the Brooks Atkinson Theatre, Gershwin Theatre, Lunt-Fontanne Theatre, Minskoff Theatre, Nederlander Theatre, Neil Simon Theatre, Palace Theatre and Richard Rodgers Theatre (collectively know as “VENUE” or “VENUES”), in compliance with the ADA. Moreover, The Nederlander Organization recognizes that guests with disabilities may not be able to readily access this seating without fair and adequate ticket policies. Therefore, The Nederlander Organization strives to accommodate the individual needs of its guests with disabilities (and their companions) by providing accessible seating in several areas of the theatre (see sections below on Accessible Seating and Ticketing). The Nederlander Organization will investigate the potential misuse, misappropriation, theft and/or fraud (“fraud”) involving accessible seating tickets (including companion seating), and will use any legal means at its disposal to prevent such misuse, up to and including criminal prosecution for fraud. Accessible seating ticket fraud includes, but is not limited to, misrepresentation of a disability for the purpose of obtaining accessible seating. The Nederlander Organization reserves the right to take appropriate action up to and including investigating, relocation, or ejection for accessible seating ticket fraud.

The Nederlander Organization will review its ticketing policies periodically to ensure that they are adequately meeting the needs of guests with disabilities.

The Nederlander Organization is proud to offer its guests three (3) different types of Accessible Seating options:

Wheelchair accessible tickets and companion seats

Wheelchair accessible tickets are spaces reserved for guests who will remain in their wheelchair to enjoy the show. Companion seats are reserved for guests who accompany individuals purchasing wheelchair accessible tickets. Companion seats are located directly next to the wheelchair locations when available. (See details under “Accessible Seating and Ticketing”)

Aisle Transfer seats

Aisle Transfer seats are reserved for guests who have limited mobility. This seat is always on an aisle and has a movable/folding arm to allow the guest easier access to the seat. Please be advised that some aisle transfer seating requires the use of stairs to access. (See details under “Accessible Seating and Ticketing”)

Low Vision/Deaf & Hard of Hearing

These seats are reserved for Low Vision/Deaf & Hard of Hearing guests. These seats are located close to the stage for optimal enjoyment of the show. (See details under “Accessible Seating and Ticketing”)

ACCESSIBLE SEATING AND TICKETING

Wheelchair accessible tickets and companion seats

Tickets for wheelchair users and their companions for individual events shall go on sale at the same time as tickets for customers without disabilities. Wheelchair users shall enjoy the same access to the ticket sales process as customers without disabilities. Wheelchair users and their companions shall be afforded a choice of seating locations from among all of the wheelchair locations (except for those already sold to wheelchair users).

(i)                Wheelchair users shall be limited to one (1) wheelchair space and three (3) contiguous companion seats per order. The companion seat will be contiguous to the wheelchair space, subject to availability. Wheelchair users and their companions (both non-disabled and other wheelchair users) shall be permitted to purchase additional seats as close as possible to the wheel chair seat subject to availability.

(ii)               If a wheelchair user requires more than one (1) companion seat, the wheelchair user may purchase additional seats, if available, near the accessible seat at the regular price for that section of seating in the same transaction based on availability up to the ticket limit established for the event based on the per order ticket limits set for all guests, including those without disabilities.

(iii)              If a group of tickets is purchased for a performance and a guest within the group requires accessible seating, upon prior notification of the performance, the Venue box office will use best efforts to accommodate the accessible needs of the guest.

(iv)             Subject to availability, the Venue will make reasonable accommodations to people with disabilities who purchased tickets for non-accessible seats but require accessible seats in its Venue.

(v)              The Venue will allow people with disabilities who purchased tickets for seats in accessible areas to transfer tickets to third parties as they do non-accessible tickets in its Venue.

(vi)             The Venue will not require proof of a disability when individuals purchase accessible tickets for its Venue, however, they reserve the right to inquire if the purchaser has a mobility disability, has a disability requiring seats in an accessible area, or is purchasing for someone with a disability who requires the same.

(vii)            The Venue reserves the right to take appropriate legal action against anyone who fraudulently obtains seats in any Accessible Seating area.

(viii)           Wheelchair tickets and their companion tickets may be offered for sale to customers without disabilities commencing the earlier of:

a.   Four days (96 hours) after all publicly available non-accessible seating (excluding unsold single seats) is sold out for a particular performance, or

b.   In the event that all publicly available non-accessible seating locations (excluding unsold single seats) are sold out within four days (96 hours) of a scheduled performance, the Venue shall be permitted to release the unsold wheelchair and companion seating locations for sale to the general public.

Aisle Transfer Seats

Seats with movable/folding armrests will be made available for guests with disabilities who require this type of seating. These tickets shall go on sale at the same time as tickets for guests without disabilities. Guests who require movable/folding armrests shall enjoy the same access to the ticket sales process as customers without disabilities. The Venue reserves the right to change these seating locations on a performance-by-performance basis.

(i)      Guests who require Aisle Transfer Seats shall be limited to one (1) aisle transfer seat per order. A guest may purchase additional non-accessible seats near the aisle transfer seats based on availability up to the ticket limit established for the event based on the per order ticket limits set for all guests, including those without disabilities.

(ii)    Aisle Transfer Seats may be offered for sale to guests without disabilities commencing the earlier of:

a.   Four days (96 hours) after all publicly available non-accessible seating (excluding unsold single seats) is sold out for a particular performance, or

b.   In the event that all publicly available non-accessible seating locations (excluding unsold single seats) are sold out within four days (96 hours) of a scheduled performance, the Venue shall be permitted to release the unsold Aisle Transfer seating locations for sale to the general public.

Low Vision/Deaf & Hard of Hearing

Seats will be made available for Low Vision/Deaf & Hard of Hearing guests in specific seating areas. These tickets shall go on sale at the same time as tickets for customers without disabilities. Guests with low vision or a hearing disability shall enjoy the same access to the ticket sales process as customers without disabilities. The venue reserves the right to change these seating locations on a performance-by-performance basis.

(i)      Guests who require seats in designated Low Vision/Deaf & Hard of Hearing area shall be limited to one (1) seat and one (1) companion seat.

(ii)    Low Vision/Deaf & Hard of Hearing tickets may be offered for sale to customers without disabilities commencing the earlier of:

a.   Four days (96 hours) after all publicly available non-accessible seating (excluding unsold single seats) is sold out for a particular performance, or

b.   In the event that all publicly available non-accessible seating locations (excluding unsold single seats) are sold out within four days (96 hours) of a scheduled performance, the Venue shall be permitted to release the unsold Low Vision/Deaf & Hard of Hearing seating locations for sale to the general public.
